These Terms of Service (“Terms”) govern your access to and use of the website, online store, and related services operated by Pillow Flow LLC (“Pillow Flow,” “PillowFlow™,” “we,” “us,” or “our”) at https://pillowflow.com, including any subdomains, redirects, legacy domains (including pillowflow.shop), and related services (collectively, the “Services”).

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
If you do not agree, do not use the Services.

1. ELIGIBILITY & ACCEPTANCE

You must be at least the age of majority in your jurisdiction to use the Services.

By using the Services, you represent and warrant that:

  • You are legally capable of entering into a binding agreement; and

  • You will comply with these Terms and all applicable laws.

2. CHANGES TO TERMS

We may modify these Terms at any time.

Changes become effective upon posting to the Services. Your continued use after changes are posted constitutes acceptance.

It is your responsibility to review the Terms periodically.

3. DESCRIPTION OF SERVICES

PillowFlow™ sells ergonomic comfort accessories and related consumer products through an online store hosted by Shopify.

We reserve the right to:

  • Modify or discontinue products or features;

  • Limit quantities;

  • Refuse service to any person for any lawful reason.

4. ACCOUNT REGISTRATION

You may be required to create an account.

You agree to:

  • Provide accurate, current information;

  • Maintain the security of your login credentials;

  • Accept responsibility for all activity under your account.

We are not responsible for unauthorized access caused by your failure to safeguard credentials.

5. ORDERS, PRICING & PAYMENT

Orders

All orders are subject to acceptance and availability. We may refuse, cancel, or limit orders for reasons including:

  • Product availability

  • Errors in pricing, promotions, product descriptions, or inventory counts

  • Suspected fraud, misuse, or policy violations

If we cancel an order after you are charged, we will issue a refund to the original payment method.

Pricing & Errors

Prices may change without notice. Taxes, shipping, and fees are added at checkout where applicable.

We strive for accuracy, but mistakes can happen. If a product is listed at an incorrect price or with incorrect information, we may cancel or refuse orders placed for that product (even after confirmation), and we will refund any amounts paid.

Payment

Payments are processed by third-party providers (e.g., Shopify Payments, Stripe, PayPal). We do not store full payment credentials.

You agree not to initiate improper chargebacks. If a chargeback is filed without first contacting us to resolve the issue, we reserve the right to suspend related accounts or orders where permitted by law.

6. SHIPPING, RETURNS & REFUNDS

Shipping timelines are estimates only and not guaranteed.

Returns and refunds are governed by our Return & Refund Policy, and shipping is governed by our Shipping Policy, each incorporated into these Terms by reference and available on the Services.

Failure to follow return instructions may result in denial of a refund, where permitted by law.

7. RISK OF LOSS

Risk of loss and responsibility for shipped products pass to you upon delivery to the address provided at checkout, as confirmed by carrier tracking (subject to any additional rights you may have under applicable law).

8. PRODUCT USE & SAFETY DISCLAIMER (CRITICAL)

No Medical Advice

PillowFlow™ products are not medical devices and not healthcare services. Nothing on the Services constitutes medical advice, diagnosis, or treatment.

Assumption of Risk

You acknowledge that:

  • Use of our products is voluntary;

  • Results vary by individual;

  • Improper use may cause discomfort or injury.

You agree to use products as instructed and to consult a qualified professional for medical questions.

9. NO WARRANTIES (TO THE MAXIMUM EXTENT PERMITTED BY LAW)

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OR RELIABILITY OF CONTENT

We do not guarantee uninterrupted, error-free, or secure operation of the Services.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

PILLOW FLOW LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Lost profits

  • Lost data

  • Business interruption

  • Personal injury (to the extent caused by misuse or circumstances not attributable to our gross negligence or willful misconduct)

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the maximum extent allowed.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Pillow Flow LLC and its owners, officers, employees, contractors, and partners from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising out of:

  • Your use or misuse of the Services or products;

  • Your violation of these Terms;

  • Your violation of any law or third-party rights.

12. INTELLECTUAL PROPERTY (VERY IMPORTANT)

All content and products, including but not limited to:

  • Product designs and shapes

  • Ergonomic geometry

  • Strap systems

  • Molds, prototypes, and engineering features

  • Branding, logos, names

  • Packaging, images, videos, diagrams

  • Website content and copy

are the exclusive intellectual property of Pillow Flow LLC and are protected by U.S. and international IP laws (including copyright, trademark, and patent-pending rights).

You may not:

  • Copy, reproduce, reverse-engineer, or manufacture our products;

  • Create derivative or competing products using our designs;

  • Use our branding or content without written permission;

  • File or assist in filing conflicting IP claims.

We reserve the right to seek injunctive relief (court orders) and other remedies for any actual or threatened infringement or misuse of our intellectual property.

13. USER CONTENT & FEEDBACK

If you submit reviews, feedback, images, videos, or other content (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, display, modify, reproduce, and distribute that User Content for business purposes (including marketing), without compensation to you.

You represent that you own or have the rights necessary to submit User Content and that it does not violate any third-party rights or laws.

14. PROHIBITED CONDUCT

You agree not to:

  • Violate any laws or regulations;

  • Infringe intellectual property rights;

  • Attempt to gain unauthorized access to systems;

  • Use bots, scraping, or automation without permission;

  • Engage in fraud, abuse, deceptive practices, or interference with the Services.

We may suspend or terminate access for violations.

15. THIRD-PARTY SERVICES

The Services may integrate with third-party platforms (e.g., Shopify, payment processors, carriers, analytics tools).

We are not responsible for third-party services, content, outages, or data practices. Use of third-party services is at your own risk and subject to their terms.

16. ELECTRONIC COMMUNICATIONS

By using the Services or contacting us, you consent to receive communications from us electronically (e.g., email, site notices). You agree that electronic communications satisfy any legal requirement that such communications be in writing.

17. PROMOTIONS, DISCOUNTS & GIFT CARDS

Promotions, discount codes, and offers may be modified or ended at any time and may be subject to additional terms. Unless stated otherwise:

  • Discounts cannot be combined

  • Promotions apply while supplies last

  • Gift cards (if offered) are non-refundable except as required by law

18. TERMINATION

We may terminate or suspend your access at any time, with or without notice, for any lawful reason.

Termination does not affect provisions intended to survive, including:

  • Intellectual Property

  • Disclaimers

  • Limitation of Liability

  • Indemnification

  • Governing Law

  • Dispute Resolution & Arbitration

19. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

20. DISPUTE RESOLUTION & ARBITRATION

Mandatory Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration, not in court, except that either party may bring an individual claim in small claims court if eligible.

No Class Actions

YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY.
Class actions, class arbitrations, and representative actions are waived.

Arbitration Administration & Rules

Unless otherwise required by law, arbitration will be administered by a recognized arbitration provider and conducted under its consumer rules in effect at the time arbitration is initiated.

Location

Arbitration shall take place in Florida, unless otherwise required by law.

Opt-Out (Recommended for enforceability)

You may opt out of arbitration by sending a written notice within 30 days of first accepting these Terms, stating your name, order number (if any), and your intent to opt out, to connect@pillowflow.com. If you opt out, the class action waiver still applies where permitted by law.

21. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our reasonable control, including carrier disruptions, supply chain interruptions, natural disasters, power outages, internet failures, labor disputes, governmental actions, or other force majeure events.

22. SEVERABILITY

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

23. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Pillow Flow LLC regarding the Services.
